Some Basic Terms
Plaintiff
Definition: Someone who brings a case against another person in a court of law.
Defendent
Definition: Person or Business accused of a crime in a court of law.
Summons
Definition: Order to appear before a judge or magistrate.
Complaint
Definition: Formal notice that a lawsuit is being brought.
Pleadings
Definition: The complaint and the answer combined in a civil case.
Pretrial Conference
Definition: Short hearing where judge informs parties of steps necessary to get ready for trial.
Arbitration
Definition: Where third party listens to plaintiff and defendant, reviews the case and makes a final decision that's binding for both parties.
Preponderance of Evidence
Definition: Greater weight of the evidence required in a civil lawsuit for the fact judge or jury to decide in favor of one side or the other.
Mediation
Definition: Third party helps plaintiff and defendant reach an agreement.
Trial
Definition: Formal examination before a judge or jury to decide guilt in case of criminal or civil proceedings.
Appeal
Definition: If the loosing party believes something went wrong in the case, they can ask for a review from a higher court.
Verdict
Definition: Decision in case made by judge or jury.
