The 1st amendment
Congress shall make no law respecting an establishment of religion, or prohibiting the excersice thereof; abridging the freedom of speech, or of the press, or the right of the people to peaceably to assemble, and to petition the government of redress of grievances.
Description of the amendment
The reason this amendment was created was to add this to the bill of rights because not everyone was approving the constitution. But this amendment only applied to white males, so later on this amendment was incorporated with the fourteenth amendment and gave right of women and African Americans. The 1st amendment gives you the freedom of speech, religion, freedom to assemble, the freedom of press, and the the right to petition grievances.
Supreme Court Case
In 1990 , Board of education of west side community schools v. Mergens . Court ruled that if the high schools created clubs not containing the curriculum they couldn't discriminate against clubs in a religious orientation. The court said that there was a crucial difference between a government speech endorsing religion. Which the establish,don't clUse forbids, and private speech endorsing religion , which the free speech and free excersice clause protects.
