Awareness of Duty

a motivating awareness of ethical responsibility A person must be aware that they were not supposed to do something. When the law is on books people should know about them. If someone killed someone and said they did not know that they should do that. It says you can not murder someone.

Violation of Duty

to break, disregard, or infringe (a law, agreement, etc.) If you were pocketing money on the side from a business. If the law is on the books and you break it there is no need to establish the element existed until you go to court.

Criminal Intent

The state of a persons mind. Can be used to determine if someone is guilty or innocent. If someone walked into a store and picked gum off a rack and went tot he bathroom. Then after left the store without paying. They may have forgot they had it.
