Message from Superintendent Mueller
Good evening, Islanders.
After receiving media inquiries throughout the day regarding our plan to hold our graduation ceremony on Niedermeyer Field, we were contacted by the County Department of Public Health. In response, we issued the attached statement. Unfortunately, San Diego County Public Health Officer, Dr. Wilma Wooten, responded to our statement with a cease and desist order. The order states the following:
The State COVID-19 Industry Guidance applicable to schools states that non-essential visitors, volunteers and activities should be limited. At this time, in-person graduation and in-person promotion ceremonies are not authorized gatherings. To the extent there is any uncertainty as to this issue, pursuant to California Health and Safety Code section 12017 5 .5 (b ), you are ordered to cease and desist from holding an in-person graduation or promotion ceremony.
The County Public Health Office has determined that non-essential visitors, volunteers and activities should be limited. State COVID-19 Industry Guidance does not state that in-person graduation and in-person promotion ceremonies are not authorized gatherings.
CA Health and Safety Code section 120175.5 (b) states:
120175.5. (a) During an outbreak of a communicable disease, or upon the imminent and proximate threat of a communicable disease outbreak or epidemic that threatens the public’s health, a local health officer shall do both of the following: (b) In addition to the actions required under subdivision (a), the local health officer may issue orders to other governmental entities within the local health officer’s jurisdiction to take any action the local health officer deems necessary to control the spread of the communicable disease.
Mr. Schmeichel will communicate a plan to our graduates and families on a contingency plan for tomorrow.
We regret that the Public Health Officer has issued this order. Our plan for an in-person graduation adhered to all published health and safety regulations. We do not agree with the rationale, but we have no choice but to abide by it.
