Summons and Pleadings
Whether you're the plaintiff, or defendant, recipient of a summons or filer of complaints, you should know what to expect before the trial. At a pre-trial conference, all involved parties meet to clarify any unclear details or differences and prepare for the trial by gathering evidence and such. Be sure to hire a good lawyer, and present your pleadings - either your summons/complaints towards the other party, or your answer to the complaint filed against you. This first step can be the most important.
Involved Parties:
Plaintiff
The person who files the claim against the defendant.
Defendant
The person against whom a complaint is filed, and whom receives a summons informing them of this.
Mediation
In divorce cases commonly, mediators do arbitration, or settle a dispute, between both parties, in the form of a settlement or something different.
The Final Verdict
In a civil case, there must be a preponderance of evidence - standard of proof - in order for the plaintiff to win the suit. If either party is unhappy with the verdict the judge or jury provides, then they are welcome to appeal their case for further review.
