ESY student names needed by Friday!
Hi team!
Please complete this spreadsheet with ANY and ALL students that will be attending ESY this summer. This needs to be completed by Challenge Day so we can ensure we have staff hired to support.
I have added a comments section if the student was ARDed for ESY but parents have indicated they are not going to attend, you can put the students name with cross throughs and add in comments, parents declined.
You can also add if not ARDed yet and anticipated ARD date, so we can plan accordingly

Resist relyiing on informal "shadow suspensions" involving parent pick ups
Resist relying on informal 'shadow suspensions' involving parent pickups
When a student with a disability acts out in class and will not calm down, his school may see it as reasonable to contact his parents to remove him from school.
"Sometimes a child's behavior changes drastically, and you may have to have them picked up," said Jessika Kleen, a school attorney at Machado Law Group in Springfield, N.J. "But that should be fairly rare."
This kind of removal may equate to a "shadow suspension," an undocumented form of discipline. Have you seen an administrator call a parent to pick her child up from school without documenting it? How about separating a student from his peers for lunch, removing him from recess, or otherwise singling him out in a negative way? These are all examples of shadow discipline to manage challenging behavior.
Shadow discipline differs from exclusionary discipline methods, such as out-of-school suspensions and expulsions, because it's not properly tracked.

YOU BE THE JUDGE: Did visiting principal err in restraining student in body sock?
An Indiana student had an IEP that identified kicking, hitting, throwing items, screaming profanities, and knocking items off desks as behaviors of concern. The IEP allowed staff with crisis intervention training to use a therapeutic hold when the student engaged in dangerous behaviors and less intrusive interventions had failed. After the student began physically acting out one morning while using a body sock as a sensory tool to attempt to calm down, a visiting principal used a therapeutic hold on the student.
The parent argued that the district failed to implement the student's IEP when it allowed a visiting principal with no training in crisis prevention interventions to restrain the student. The district pointed out that the student's regular teacher and school principal were both absent on the date of the incident and that the visiting principal responded to a call for assistance by the substitute teacher and other staff.
A district must implement the special education and related services identified in a student's IEP. 34 CFR 300.323 (c)(2).
Is Ind. district liable for IEP implementation failure?
