Jordan Smith Block:5 Date:12-11-14
court case: Pervear v. Commonwealth
Pervear was the first test of the eight amendment before supreme court. The defendant was convicted for illegally selling and keeping intoxicating liquors its fine of fifty dollars and three months imprisonment was determined to be constitutional, as it was the usual mode adopted in many, perhaps all of the states.
Court Case scenario: James v.
James was convicted for drinking on the job and constantly harassing the customers. His fine was 300,280 dollars and he has life imprisonment. But it's not constitutional that if you drink on the job and harass others you shouldn't be imprison for life but maybe half of it. A lot of states has not really adopted that.
