Happy Holidays! Have a Wonderful Holiday Break!
The IDEA § 300.503(a), in part, says that written notice must be given to the parents of a child with a disability. So giving it to the child to take home to the parent would not be compliant. In fact, there have been complaints where the district has been found non-compliant because the IEP or Notice was sent home with the student. Notice is of sufficient importance that the district must document delivery.
Don't forget to collect data before and after Christmas break to have documentation for and against the need for ESY.
