Website Accessibility Compliance under the ADA and FHA
Since mid-2017, there has been an uptick in the number of lawsuits filed against companies operating consumer-facing websites under the Americans with Disabilities Act (ADA), alleging that the websites do not provide appropriate accommodations for those with vision or hearing disabilities.
More recently, we are seeing an increase in website accessibility lawsuits asserting claims under the federal Fair Housing Act (FHA), in addition to the claims asserted under the ADA. The FHA claims generally allege that the lack of accessible housing websites exists as a barrier to equal housing opportunities. While website compliance under the ADA is a growing issue for those in the apartment management industry, these lawsuits also target many other industries such as financial services, hospitality, retail, energy, fitness and healthcare, to name a few.

Removal of the Daily Late Fee Provision in the NAA Lease Contract
Dear Members,
NAA’s Legal Affairs team tracks litigation trends in the industry – a consistent issue has been late fees. With late fees under scrutiny and the recent increase in late fee litigation and legislation across the country, NAA has made the decision to remove the daily late fee provision from the NAA Lease Contract in states in which it currently appears. However, a field for the collection of a late fee will remain.
Going forward, if you would like to include a daily late fee provision, we encourage you to work with your local counsel to add the daily late fee language to the Special Provisions section of the lease.
We will continue to provide two (2) weeks advance notice prior to the release of these changes in affected states. We are sending this notice to provide you with as much advance notice as possible.

Leadership Lyceum Candidate
We would like to congratulate our RRAA President, Samantha Lord on her recent appointment as a 2020 NAA Leadership Lyceum candidate. She was awarded one of four Emerging Leaders fellowships by Chairman Mike Holmes. We are very proud of her prestigious accomplishment!
For those of you who may not be familiar with the NAA Leadership Lyceum program, it is an exclusive one-year leadership development program. Every year, there is a class of 30 candidates comprised of NAA members who have been appointed or selected by NAA leaders through a competitive application process to participate and further their volunteer leadership service at a national level.
This program is designed to identify, inform and empower successive waves of National Apartment Association volunteer leaders. Lyceum candidates receive extensive information about the National Apartment Association, from governance to the work of each department to programs and industry issues. They also learn the key responsibilities of association boards and board members along with the attributes of a high functioning board. Selected candidates participate in a wide range of leadership development experiences over the course of one year. They must be active NAA members and NAA volunteers with NAA Affiliates at the state, local, or national level. The program content is delivered at three sessions concurrent with the NAA's three major annual conferences.
Samantha will proudly represent the River Region Apartment Association and the Alabama Apartment Association.
GBAA Constant Contact Hacked
As many of our members and previous members know, the GBAA's Constant Contact account was compromised over the Holidays.
We would like to apologize for any inconvenience this may have caused you.
However, the security team at Constant Contact caught it immediately and disabled the account. No one was "debited" any amount.
The GBAA and Constant Contact have taken additional measures to re-set all of our information.
The GBAA does not invoice through Constant Contact. Our accounting system does not save all of the information needed to debit a credit card. One of our staff would have to speak with someone to retrieve security codes, etc. in order to pay an invoice with a credit card.
Again, we would like to express our most sincere apologies.
