Text of the amendment

The right of people to be secure in their persons,houses papers,and effects against unreasonable searches and seizures,shall not be violated,and no warrants shall issue,but upon probable cause,supported by Oath or affirmation and particularly describing the place to be searched,and the persons or things to be seized.

Description of the amendment

The 4th amendment to the United States constitution was added as part of the Bill of Rights on December 15,1791.It deals with protecting people from the searching of their homes and private property without properly executed search warrants.

Amendment in my own words

Police can't just walk into your house, search through your stuff, and take it away.First they need to get a search warrant.And for that,they must give a really good reason for the search.They also have to say exactly where they want to search and what they are looking for.

Supreme Court Case

Illinois v.Gates (1983)

There the court stated that a judge should weigh all evidence when considering a warrant,including tips that fail the Aguilar-Spinelli test.This ruling made it easier for the police to obtain warrants using information tips.

Courts decision

The court ruled that the conviction of alleged gambler warren spinelli must be reversed because an informats tip was not sufficient reliable.For years the court applied its so called Aguilar-spinelli test to determine whether an informat's information provided sufficient probable cause under the Aguilar-spinelli test the government must show a reviewing type of judge.
