YOU BE THE JUDGE: Did narratives sent home in backpack appropriately report 20-year-old's transition progress?
A 20-year-old student with an intellectual disability deferred graduation. The student held internships in the district's preschool, high school office, and cafeteria. The district provided weekly reports to the parents in the student's backpack. They were brief narratives with observations describing the activities the student did each day in the internship settings, including wiping down cafeteria tables, setting up chairs, and working with custodians. The IEP provided that the student would receive a weekly evaluation on how things are going in the preschool and office.
One progress report stated that the student was doing well and received "solid reports," or positive evaluations. The student mastered one of his IEP goals during the first quarter. The district provided quarterly progress reports and the complete set of weekly reports to the parents at their request at the end of the school year.
The parents filed a state complaint alleging that the district didn't have an IEP in effect. They asserted they weren't provided transition reports and that reports for the student's other goals lacked data to determine if the student was meeting them.
The IDEA provides that public schools must have an IEP in effect for each student with a disability that is designed to meet the student's needs and enable him to make progress. It must also describe how progress will be measured.
Were the parents able to determine progress on transition goals? Click on an answer below to see how the court ruled.
