Court Case and Mask Mandate
Hello D103 Families,
On Friday, February 4, in Sangamon County, Judge Grischow issued a Temporary Restraining Order (TRO) in a lawsuit in which District 103 was named as a defendant. Due to a separate ruling limiting the scope of the litigation, the order applies only to the parties to the lawsuit. The TRO will be appealed and may be stayed, meaning that the order could be placed on hold while the appeal is decided.
The Board held an emergency closed session meeting tonight, February 6, to discuss the lawsuit and review advice from legal counsel regarding the TRO. Because future court rulings may go back and forth, and because changing our policies would cause confusion and disruption in our schools, District 103 is administratively extending the requirement that, except for the plaintiffs named in the suit, masks must be worn by all students, staff, and visitors while in D103 schools. Once a final decision is made by the courts, we will revisit the District’s masking requirement.
Aside from the parties to the lawsuit, the District will continue to enforce requirements relating to masks and school exclusion for close contacts. In addition, please note that all students remain subject to the federal order requiring all passengers on school buses to wear masks. Also, the District will continue to follow procedures for exclusion of symptomatic individuals and will continue to engage close contact tracing.
We will continue to keep our D103 community informed regarding the appeal process and the outcomes that affect our district.
Sincerely,
Scott Warren, Ed.D
Superintendent of D103 Schools
