Amendments 1 and 2
The right to free speech, press, religion, assembly, and petition. Also, the right to bear arms.
Amendment 2: Right to bear arms
"A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."
This is the 2nd amendment. It basically means that everyone has the right to own and carry a gun.
Why was the second amendment written?
These are some of the reasons that the second amendment was added to the constitution; enabling the people to organize a militia system, participating in law enforcement, deterring tyrannical government, repelling invasion, suppressing insurrection, allegedly including slave revolts, facilitating a natural right of self-defense, and many more.
The 2nd Amendment Song
Should people be able to own guns?
Shouldn't people be able to own guns?
My Opinion On Amendment 2
I think that it is unnecessary for the average civilian to own a gun. I think this because, if no one, other than military officers owns a gun, then there will be much less crimes. Other people argue, "If I own a gun, then I can protect myself if someone tries to harm me or my family". Well, if no one owns a gun, then those crimes wouldn't happen in the first place. Roughly 16,272 murders were committed in the United States during 2008. Of these, about 10,886 or 67% were committed with firearms. If these criminals didn't own guns, then this wouldn't have happened. Also, if the deranged man who killed the children at the Sandy Hook School didn't have a fully automatic weapon, then the killer wouldn't have been able to kill nearly as many people.
Amendment 2 in the news!!!
In the case of Columbia vs. Heller the court ruled that the Constitution protects an individual’s right to own a gun for personal use. Many people are trying to change that law, and ban certain types of weapons from being sold. The NRA (National Rifle Association) doesn't want any guns to be banned. This was a big issue during the election, and especially now since the shooting in Sandy Hook.
Amendment 1: Freedoms Amendment
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
In the first amendment it states that people have the right to assembly, speech, petition, press and religion. This means that people have the right to say whatever they want, with the exception of libel and slander. Also, it gives people the right to practice whatever religion that they want. It also means that the government can't censor the media with certain restrictions.
Freedom of Speech
Freedom of speech means that people have the right to say whatever they want, with some exceptions. EX: libel, slander, and you can't yell "bomb" in an airport.
Current example
"The Kountze High School cheerleaders in Texas will be able to cheer on their teams with a little biblical inspiration at least through the end of this school year. A judge today said their Christian banners can stay until the matter is decided in a June lawsuit, reports the AP. The cheerleading squad creates huge banners with lines such as "If God is for us, who can be against us?" and an atheist group has sued. The cheerleaders have strong public backing from Gov. Rick Perry and state Attorney General Greg Abbott." http://www.newser.com/story/156071/judge-lets-cheerleaders-keep-bible-banners.html
explanation of CurrEnt ExamPlE
There were a group of cheerleaders that were exercising what they thought was their right to free speech, by making signs that read things like "If god is for us, who can be against us?" An atheist group saw these signs and sued the cheerleaders. The cheerleaders won the case, because the first amendment says that they have the right to write what they want.
My opinion on the freedom of speech
I think that the freedom of speech is great, as long as it has boundaries. Good boundaries are when they say that you can't say anything that will instigate violence.
Freedom of Religion
Freedom of religion means that you have the right to attend any place of worship that you choose, and also practice any religion that you choose.
current example
There are a lot of church's that will kick people out or not let them in if they are gay. This goes against freedom of religion, because you are supposed to be allowed to attend any church, temple, mosque, etc. that you wish to attend.
My opinion on the freedom of religion
freedom of religion is a freedom that in my opinion should have no boundaries. Anyone should be able to pray anywhere and worship anyone without other people telling them that they can't.
Freedom of the Press
Freedom of the press means that a newspaper can print whatever they want, and the government can't stop them from printing an article.
current example
People didn't think that the details on killing Osama BinLaden should have been released. The press released it anyway, facing serious charges. The people who printed the article won the law suit, because they argued that they have the right to freedom of the press.
my opinion of freedom of the press
I don't like the freedom of the press law. I think that government should be able to regulate the newspaper, because they (the newspaper article writers) could be sending false and potentially harmful information throughout the country.
Freedom to assemble
Freedom to assemble means that people have the right to gather themselves in a group wherever they like. It is also your right to protest.
Current example
After the shooting at Sandy Hook, people in Washington DC, marched and assembled down the streets. They did this, because they think that gun laws, banning certain guns, should be passed.
my opinion on the freedom to assemble
I think that freedom of assembly is okay, if there are restrictions. For example, if I were to get a group of people to stand in front to a building that I don't agree with what they were doing in the building, that's not okay, because people get really serious about that kind of thing and it could get violent. When freedom of assembly is good, is if there is a group of people that are holding a fundraiser and they want to stand outside and talk about fundraiser, and handout flyers and stuff, then that's fine.
Freedom to petition
This means that when people don't like something they can sign a petition to try and change whatever issue they would like.
current example
People are petitioning for there to be much stricter gun laws across the United States, especially after Sandy Hook. Also, that certain guns and ammunition shouldn't even be sold.
My opinion on the freedom to petition
I think that there is nothing wrong with petitioning, if you want to change a rule, then I'd say "fine, go for it, petition, fight for what you want, without being violent".
Why was the first amendment written?
Our rights come from a power higher than the government. If the government could regulate a state religion, there would be no power higher than the official government. Then, our rights would come from our government, and could be taken away by them. Also, in England people were arrested for practicing certain religions or speaking freely against their government. Our forefathers wanted to give the people more rights than they had in England.
My Opinion On Amendment 1
I think that all of the freedoms listed in the first amendment are fair and should be left alone. This amendment gives us many freedoms that let us be us. It allows us to listen to whatever music we like and go to any church, temple, mosque, etc. that we wish to attend.
