Compliance Reports Due September 30
TEA is announcing the availability of the following compliance reports, authorized under the Elementary and Secondary Education Act (ESEA) of 1965, as amended by the Every Student Succeeds Act (ESSA).
2021-2022 ESSA Consolidated Compliance Report
2021-2022 Rural and Low-income Schools (RLIS) Compliance Report
These reports are available on eGrants under the Compliance Reports tab. Sample compliance reports, instructions, and training videos are available on the Federal Program Compliance Division web page through the Division Resources section.
Reporting Deadline
Reports are due via eGrants by September 30, 2022.
ESSA Consolidated Compliance Reports
The ESSA Compliance Reports are now available in TEAL. Reports are due by September 30, 2022.
TEA has posted the 21-22 ESSA Consolidated Compliance Reports Resources. Resources include mockups, Program Compliance Self-Check Guide, instruction documents and training videos for each of the compliance reports are available.

Annual Micro-Purchase Self-Certification
Updated Annual Micro-Purchase Self-Certification Notification to TEA
The 2022-2023 LEA Micro-purchase Self-Certification notification to TEA is now available for submission in the EDGAR Forms Smartsheet WorkApp. This form must be submitted annually due to eligibility potentially changing on a yearly basis. The form has been streamlined and contains no attachments. Auditors and fiscal monitors will verify eligibility and compliance during fiscal reviews of federal funds.
LEAs may certify by grant year (July 1 - June 30) or by the LEA’s fiscal year. The self-certification must be submitted to TEA through the online system by October 1 to be retroactive back to the start of the grant/fiscal year. Self-certifications submitted to TEA after October 1 of the current grant/fiscal year will not go into effect until the date it is submitted to TEA and any procurements started prior to the submission date must adhere to the standard $10,000 micro-purchase threshold.
The form can be access by authorized LEA users in the EDGAR Forms Smartsheet Workapp, which can be accessed here.
District Equity Plans
Title I, Part A, Sec. 1112(b)(2) of the Every Student Succeeds Act (ESSA) requires all local educational agencies (LEAs) that receive Title I funds to create plans describing how the LEAs will decrease gaps as they relate to low-income students and students of color being taught at higher rates than other students by inexperienced, out-of-field, and ineffective teachers.
For the 2022-2023 school year, LEAs will not be expected to submit new equity plans. LEAs should review their current plans locally, consider opportunities for revision, and implement the identified strategies accordingly. More details on equity planning, strategies, implementation, and state data can be found in the Texas Equity Plan Toolkit.
For LEAs that prefer to use the Texas Education Agency’s template, please note that the agency has updated the Equity Plan Template and will also provide a new exemplar plan on the Texas Equity Plan Toolkit by September 2022.

2022-2023 ESSA Consolidated Federal Grant Application
TEA Communication on 2022-23 ESSA Consolidated Grant Application Errata 2
Summary:
TEA is announcing changes to the 2022-2023 ESSA Consolidated Federal Grant Application Program-Specific and ESSA Provisions and Assurances. The errata are available on the TEA Grant Opportunities page. Please see Errata 2 (posted on August 26, 2022) for changes to this grant.
The update includes a new section for Prohibition of ESEA Program Funds Used for Possession of and/or Training with Dangerous Weapons:
The LEA assures that no funds under the ESEA will be used for the provision to any person of a dangerous weapon, as defined in section 930(g)(2) of title 18, United States Code, or training in the use of a dangerous weapon. [Section 8526 of the Elementary and Secondary Education Act of 1965 (ESEA) as amended by the Bipartisan Safer Communities Act, Section 2938, Division A-Mental Health and Firearms Provisions, Title III-Other Matters, Subtitle D-Amendment on ESEA Funding, Section 13401]
A dangerous weapon is defined in section 930(g)(2) as a weapon, device, instrument, material, or substance, animate or inanimate, that is used for, or is readily capable of, causing death or serious bodily injury, except that such term does not include a pocketknife with a blade of less than 2 1/2 inches in length.
Please note, the prohibition went into effect immediately on June 25, 2022, and applies to all ESEA funds, existing and future awards under all ESEA programs.
Affordable Connectivity Program (ACP) for Learners and Families
Below, please find information shared by the U.S. Department of Education related to the Federal Communication Commission’s (FCC’s) Affordable Connectivity Program (ACP).
One of the most critical challenges illuminated by the recent period of emergency remote learning has been providing access to reliable, high-speed internet and connected devices to facilitate everywhere, all-the-time learning. Data clearly show the lack of these essential technologies impact communities of color and low-income communities to a disproportionate extent. As schools recover from the pandemic, several federal agencies and the Office of Educational Technology (OET) are stepping up to provide resources to close the digital divide.
For Learners and Families: getinternet.gov
The FCC’s Affordable Connectivity Program (ACP) allows qualifying households to reduce their internet costs by up to $30/month ($75/month on Tribal lands). Getinternet.gov is a simple, easy-to-use website with details on how households can sign up for ACP and find participating providers in their area. Several companies additionally committed to offer ACP-eligible families at least one high-speed plan for $30/month or less, with no additional fees and no data caps. This mean that if households apply their ACP benefit to one of these plans, they would have no out-of-pocket cost for internet.

To help schools and districts as they assist with ACP sign-ups, OET collaborated with the FCC and USDA to update the OET website with FAQs and resources to facilitate communication with families about their ACP eligibility. This includes a template letter to let families know their child receives free or reduced-price school meals and therefore meets the ACP’s eligibility criteria. OET also provides a sample form that can be used to obtain families’ consent.

Title II, Part A Highlights
Prioritization of Funds
Title II grant focus is on providing low-income & minority students greater access to effective teachers, principals & school leaders.
High Need Schools is defined as low income schools with high percentages of ineffective teachers and high percentages of students who do not meet state academic standards.
Compliance Documentation Includes:
- Include statement in DIP describing how LEA prioritized funds to campuses in School Improvement and campuses serving Title I students.
- Maintain documentation of Title II activities and their costs for each campus in LEA demonstrating prioritization to Title I and School Improvement campuses.
- Schools that are benefiting from Title II funds should have in the CIPs the strategies and Title II funding source documented.

Title IV, Part A Highlights
Allowability FAQ on Security Fencing and/or Security Hardware
Over the past few weeks, TEA has received LEA questions asking if Title IV, Part A funds could be used for LEA campus security fencing and/or security hardware. TEA has developed an FAQ that will be posted in the next update to the TEA TIVA FAQ.
Question: May Title IV, Part A funds be used to pay for school campus security fencing and hardware?
Response: It would be difficult to justify that use of Title IV, Part A funds would be reasonable and necessary for performance of the grant (i.e., of a type generally recognized as ordinary and necessary for operation of the grant) and allocable to the grant (i.e., chargeable to the grant award in proportion to the benefits received by the grant award as a result of the cost). Additionally, it would be difficult to evaluate for program effectiveness. However, if the LEA decides that it can document such justification and evaluate the use of funds for program effectiveness, it would be up to the LEA to provide such documentation to an auditor and/or TEA program staff in the event of an audit. TEA or audit staff would make the final determination concerning whether the documentation is sufficient to demonstrate compliance with the Title IV, Part A use of funds statutory requirements. Based on the guidance provided above, as Program Director, I would not recommend Title IV, Part A funds be used for the purpose requested. However, the decision to use funds in this manner is an LEA decision.
Title IV Funds Not Allowable for Use of a Dangerous Weapon Training
One aspect of Title IV-A allowability that has received recent attention is around the use of Title IV-A funds to pay for weapons and weapons training. The Title IV-A program State coordinators received information from the United States Department of Education resolving this question.
The Office of Safe and Supportive Schools at the United States Department of Education shared information regarding S. 2938, the Bipartisan Safer Communities Act, signed into law by President Biden on June 25, 2022.
Section 13401 of the Act amends section 8526 of the Elementary and Secondary Education Act of 1965 (ESEA) to add a prohibition that no funds under the ESEA may be used for the provision to any person of a dangerous weapon, as defined in section 930(g)(2) of title 18, United States Code, or training in the use of a dangerous weapon. Free Virtual and In-person TCOLE #4064 Trainings
The Texas School Safety Center has announced free virtual and in-person TCOLE #4064 Trainings across the state. This training is open to school-based law enforcement officers, public ISDs, open-enrollment charter schools, junior colleges, and state agencies that support schools. Due to limited seating, vendors and contractors are not permitted to register or attend the training. View Dates and Register
In-person training will take place at Region 10 ESC on December 1 and 2, 2022. Please see additional information on important dates and training locations below.
The Texas School Safety Center School-Based Law Enforcement (SBLE) Training Division is offering free virtual and in-person TCOLE #4064 trainings. The goal of this training is to assist SBLE officers and school districts with compliance with legislative mandates requiring districts employing a peace/resource officer to create a policy requiring officers to complete education and training.
These trainings will be 20 hours divided into two 10-hour days. We have updated training materials to ensure that participants receive the most current information available. Topics will include:
- Child and Adolescent Development and Psychology
- Mental Health Crisis Intervention and Cultural Competency
- De-escalation Techniques and Techniques for Limiting the Use of Force, Including the Use of Physical, Mechanical, and Chemical Restraints
- Mental and Behavioral Health Needs of Children with Disabilities or Special Needs
- Positive Behavioral Interventions and Supports, Conflict Resolution Techniques, and Restorative Justice Techniques
This training is free, but registration is required. Please register early for both virtual and in-person trainings. Participants must attend the entire in-person training to be eligible to receive 20 hours TCOLE Credit.
iWatchTexas School Safety
On August 16, 2022, Governor Abbott launched a public service announcement to promote the awareness of the iWatchTexas School Safety Reporting System. The intent of this letter is to provide additional information to school systems about iWatchTexas and how it supports safe schools and communities.

First Two Week of Enrollment - Requirements for Homeless & Foster Care Students
Each school district and open-enrollment charter school shall develop systems to ease transition of a student who is homeless or in substitute care (foster care) during the first two weeks of enrollment at a new school. These systems shall include the following:

- Region 10 is currently consulting with your district’s participating private nonprofit schools and having them sign the Affirmation of Consultation. This service is for SSA members and participating PNP Cooperative members.
- Region 10 will upload those Affirmations to ESSA Reports on your behalf prior to the Sept. 30, 2022 due date.
ESSA Compliance Reports
- The PNP section is very different from last year!
- LEAs will complete the PR3099 to provide private nonprofit school (PNP) information.
- Additional, PNP data is reported in the Title I, Part A, Subpart 4 of the ESSA Compliance Report on the PR1000 form.
- LEAs will report on the number of students served by grade level, gender, and ethnicity.
- 21-22 SSA participants and Coop members:
- The Region 10 PNP team will provide the information for the PR3099 and PR1000 by September 19.
- LEAs not in the SSA or Coop, consider sending PNP schools a table that clearly identifies data required for the compliance report from both the PR3099 and the PR1000.

Equipment and supplies purchased by an LEA with CARES Act funds to provide equitable services to students and teachers in a private nonprofit school may be used for the authorized purposes of a CARES Act program during the period of performance (i.e., through September 30, 2022) or until the equipment and supplies are no longer needed for the purposes of the program.

PFE Compliance Calendar
- Conduct Parent-Teacher Conferences where school-parent compacts are discussed (required at the elementary level.) ESSA Section 1116 (d)(2)(A)
- Convene and document the Title I, Part A Annual Parent Meetings for each Title I, Part A Campus. ESSA Section 1116 (c)(1): explain the program requirements, inform parents of their right to be involved, and explain the Reservation of Funds for parental engagement and the parents’ role in deciding the use of the funds (for schools receiving $500,000 or more Title I, Part A funds.)
- Provide communications about the Title I, Part A program in a format, and the extent practicable, in a language parents understand. (Provide information to parents in a format and language they understand is practiced throughout the school year.) ESSA Sections 1112 (e)(4) and 1116 (b)(1) & (e)(5)
- If this has not been done already, distribute the District and Campus Parental Engagement Policies to parents and families. ESSA 1116 (a)(2) & (b)(1) o If this has not been done already, distribute the School-Parent Compact to parents and families. ESSA Section 1116 (d) o The Schoolwide Plan/Campus Improvement Plan shall be available to parents and families. ESSA Section 1114 (b)(2) & (4)
- A school district that assigns an inappropriately certified or uncertified teacher to the same classroom for more than 4 consecutive weeks during the same school year shall provide written notice of the assignment to a parent or guardian of each student in that classroom. ESSA Section 1112 (e)(1)(B)
