CCEE Updates
CCEE Adds a Health and Safety Guidebook to Continuity of Learning Resources
During the Summer, the CCEE released two playbooks to aid LEAs in the planning for either Distance or Hybrid Learning models. As LEAs consider plans to return to in person instruction, we wanted to make sure you knew these were still available. You will find valuable resources that you can use with stakeholders as you plan.
Earlier this week, the CCEE added a 3rd resource to this page. The Health & Safety Guidebook is designed for local educational agency (LEA) leadership teams planning for a safe return to in-person instruction in a way that maximizes future equity outcomes and addresses the diverse needs of California’s students while continuously adapting to the challenges posed by COVID-19.
Building on the COVID-19 INDUSTRY GUIDANCE: Schools and School Based Program issued by the California Department of Public Health, these guidelines and considerations are based on the best available public health data at this time, international best practices currently employed, and the practical realities of managing school operations, as new data and practices emerge. All decisions about following this guidance should be made in collaboration with local health officials and other authorities. Implementation of this guidance should be tailored for each setting, including adequate consideration of instructional programs operating at each school site and the needs of students and families. School leaders should engage relevant stakeholders—including families, staff and labor partners in the school community— to formulate and implement comprehensive plans that address six key considerations: face coverings, physical distancing, handwashing, cleaning & sanitizing, testing & tracing, and cohorting.

LCAP Advisory Services Google Site

Learning Continuity and Attendance Plan Reminders
It is the home stretch for the Learning Continuity and Attendance Plans. Please make sure to email a PDF version of the board approved LCP to your SCCOE contact (Chris, Rhonda, or Annie) by September 30th. If your plan goes for approval on the 30th please email it on October 1st. Once your plan has been submitted it will be reviewed. The SCCOE may submit recommendations, in writing, for amendments to the Learning Continuity Plan by October 30th to any school district. The governing board of a school district shall consider the recommendations submitted by the SCCOE in a public meeting within 15 days of receiving the recommendations. It is also required that your approved Learning Continuity Plan is posted to the homepage of your website.
CSI-Comprehensive Support and Improvement GMART Reporting Deadlines
Schools that were identified for CSI in FY 2018, Budget Expenditure Report 5 is due October 31, 2020 in GMART. The performance period for Report 5 is July 1, 2020 through September 30, 2020. The report requirements for this period are expenditures only. If you have no expenditures for this period please enter a zero in the ‘Expenditures’ column for each object code.
Schools that were identified for CSI in FY 2019, Budget Expenditure Report 1 is due October 31, 2020 in GMART. The performance period for Report 1 is March 25, 2020 through September 30, 2020. The report requirements are; Funding Plan Adjustment, Budget Summary, and Expenditures. Report 2 will be due on February 28, 2021 which covers October 1, 2020 through January 31, 2021. The Report 2 requirements are the date for when the schools CSI plan was approved/and or adopted and any expenditures.

Budget Overview for Parents Training
The recent passages of SB 98 and SB 820 have made some significant changes to the reporting of the 2020-21 Budget Overview for Parents (BOP). SB 98 has decoupled the BOP from the LCAP, and requires LEAs’ local governing boards to adopt the 2020-21 BOP on or before December 15, 2020, in conjunction with the First Interim Report. SB 820 further fine tunes the BOP template by aligning the report information to the district’s First Interim Budget and Learning Continuity & Attendance Plan.
The LCAP Advisory Team will be hosting two Budget Overview for Parents training to present the final version of the Budget Overview for Parents Template and Instructions for the 2020-21 school year. The content will be the same for both sessions. The training will be offered at two different dates for your convenience and will cover an overview of the new BOP Template, clarifications around directions, timeline, and technical assistance and support.

October 9, 2020, 9 a.m. – 10 a.m. or October 19, 2020, 9 a.m. – 10 a.m.SPSA Requirement for Single School Districts and Charters
Charter schools and single school districts that receive Title 1 school wide funding will be required to complete a SPSA, consistent with EC Section 64001, and form an SSC, consistent with EC Section 65000 or EC Section 65001, to meet federal school planning and stakeholder requirements for the 2020–21 school year. This new requirement for the 2020-2021 school year is due to not having a 2020-2021 LCAP. Please also note that SB 820 removed the requirement for charter schools and Single School District's to establish an SSC.Charter schools and SSDs are required to use the stakeholder engagement process for the Learning Continuity Plan, as described in EC Section 43509(b), to meet the stakeholder engagement requirements for the development and approval of their SPSA. The CDE has developed a template that is accessible on the Local Control and Accountability web page.

CARES Act (GEER & ESSER) Equitable Services Update
There is an update for those of you interacting with Private Schools for Equitable Services and CARES Act funds. Previously, there was debate between the US Dept. of ED and states about how to calculate the Proportional share --ED said to count all students and states said that it should be calculated in the same way as Title I (Section 1117). On August 26, US District court has overruled ED’s requirement of counting all students allowing for the same calculation as Title I (Section 1117). We don’t know if ED will appeal, so proceed with caution. This applies to both ESSER & GEER.
CDE has updated their ESSER FAQ page (on Sept. 3) to reflect the change (#10):
“On August 26, 2020, Judge James Donato of the United States District Court for the Northern District of California issued a preliminary injunction prohibiting ED and Secretary DeVos from applying and enforcing the Rule or ED’s prior guidance. Thus, LEAs should provide equitable services in the same manner as provided under section 1117 as discussed above. Please note that this is a dynamic legal situation, and the legal status of the Rule and guidance could change depending on the outcome of further court proceedings. Therefore, LEAs are strongly encouraged to seek their own legal counsel before making any final decisions allocating funds for the provision of equitable services.”
The ruling also addresses the process if a private school disputes the allocation (#11).

AB 331 (Medina): High School Graduation Requirements: Ethnic Studies (Gov. VETO)
This bill would add the completion of a one-semester course in ethnic studies to the high school graduation requirements commencing with students graduating in the 2029–30 school year, including students in charter schools. The bill would require local educational agencies, including charter schools, to offer an ethnic studies course commencing with the 2025–26 school year. AB 331 would also expressly authorize local educational agencies, including charter schools, to require a full-year course in ethnic studies at their discretion.
The bill would authorize, subject to the course offerings of a local educational agency, including a charter school, a student to satisfy the ethnic studies course requirement by completing either (A) a course based on the model curriculum in ethnic studies developed by the commission, (B) an existing ethnic studies course, (C) an ethnic studies course taught as part of a course that has been approved as meeting the A-G requirements of UC and CSU or (D) a locally developed ethnic studies course approved by the local board.
AB 1350 (Gonzalez): Retroactive Grant of High School Diplomas: COVID-19 Crisis (signed)
This bill would authorize a high school district, unified district, county office of education, or the governing body of a charter school to retroactively grant a high school diploma to a person who was in their senior year of high school during the 2019–20 school year; in good academic standing and on track to graduate at the end of the 2019–20 school year, as of March 1, 2020; and unable to complete the statewide graduation requirements as a result of the COVID-19 crisis.
AB 1835 (Weber): Education finance: LCFF: supplemental and concentration grants. (Gov. VETO)
This bill would require each school district, county office of education, and charter school to identify unspent supplemental and concentration grant funds by annually reconciling and reporting to the department its estimated and actual spending of those moneys. The bill would require unspent funds identified pursuant to these provisions to continue to be required to be expended to increase and improve services for unduplicated pupils, and would require each local educational agency to report the amounts of unspent funds identified in its local control and accountability plan.
Initial ELPAC Extension Approved
On September 18th Senate Bill 820 was approved and signed by Governor Newsome. This bill allows for a 45-day extension to the Initial ELPAC 30-calendar-day requirement. Local educational agencies will not have a total of 75 calendar days to administer the 2020-21 Initial ELPAC, officially score it, and provide results to parents and guardians. The CIA department is excited to announce the formal release of our Remote Assessment Resource Guide, also available in the form of a Padlet that can be bookmarked on your browser. As highlighted during our Addressing Learning Status and Measuring Effectiveness webinar on August 19th, this guide offers a curated set of key takeaways and resources on various aspects of remote assessment, with particular emphasis on formative assessment. Created with classroom educators in mind, the guide is divided into five key sections: 1) Introduction and Context; 2) Promoting Digital Citizenship for Remote Assessment; 3) Creating Authentic Learning Assessment Opportunities in Virtual Environments; 4) Translating Formative Assessment Practice to the Virtual Environment; and 5) Considerations for English Learners and Students with Disabilities. We hope that this resource proves to be a valued support in the development of your LEA’s remote assessment plans and processes.
