Did Chromebook's unreliability result in implementation failure?
A California district provided a 13-year-old with autism a Chromebook so that he could connect to the district's virtual learning platform when school buildings closed in March 2020 due to the COVID-19 pandemic.
According to the student's father, the student would lose connection to the virtual learning platform two to three times a day, and it routinely took 10 to 20 minutes to reconnect. The parents exchanged the Chromebook but continued have difficulty. The father and mother weren't always in the room with the student when he was engaged in online learning, although they were often at home. The parents ultimately purchased a new computer for the student in September so their son could stay connected.
The parents filed a due process complaint, alleging that the district denied the student FAPE by failing to provide a computer that could reliably maintain an Internet connection.
At the due process hearing, the student's teacher, who was in the virtual classroom at all times, recalled that the teen lost connection a few times but was able to reconnect within a few minutes.
The IDEA requires that a district provide an eligible student with FAPE by delivering special education and related services in conformity with the student's IEP 20 USC 1401 (9)(D).
