FACT or FICTION? Districts may limit PE services based on general education offerings
A district's obligation to provide the PE services set forth in a student's IEP depends on whether it makes PE available to all students in the same age group, regardless of disability status. Is this fact or fiction?
The IDEA Part B regulations require a district to make PE services available to students with disabilities if it makes those services available to nondisabled students. 34 CFR 300.108 (a). However, this does not mean that a district ONLY has to provide PE services to IDEA-eligible students when those services are generally available. To the contrary, the Part B regulations state that the district must provide any specially designed PE services required by a student's IEP, either directly or through other public or private programs. 34 CFR 300.108 (c).
OSEP addressed this issue in Letter to Kelly, 62 IDELR 184 (OSEP 2013). In response to an inquiry about students with disabilities ages 16-21, some of whom received instruction in community-based transition programs, OSEP stated that a district would have to provide any PE services required by students' IEPs even if those services were unavailable to nondisabled peers. Therefore, you were correct if you guess FICTION.
Answer behavioral, mental health needs with IEP-directed interventions
IEP teams should consider social, emotional, behavioral, and mental health needs of students with disabilities by incorporporating supports in their individualized education program.
