Amendments

Amendments 1 and 2

Amendment One: Freedom of Speech, Religion, Press, Petition, and Assembly

What right does it give the people?

The first Amendment gives people the right of speech, religion, press, petition, and assembly. In other words, it lets people say what they want to say, practice whatever religion they want, publish anything they want, petition or to make a formal request they want and get people to sign it, and be able to assemble whenever and wherever they want (not including private property).

What restrictions are there?

Although the people have the right to freedom of speech there still are certain restrictions like hate speech vs. hate crime. Hate speech is much different than a hate crime but it is hard to explain. Hate speech is when someone says something bad about something and a hate crime is when someone does a bad thing against someone else...

Don't understand? Here is an example. Let's say there was a man that wanted one president to win the election but another candidate won. That person is allowed to say any bad thing they want about that candidate that they want but if they say something that endagers another persons (or the president's) right to be safe then it is a crime.

There are also other restrictions, libel and slander. Libel keeps magazines newspaper, and any other written document from telling lies and printing them. Slander keps people from false statements or reports.

Why was this amendment included in the Constitution?

The first amendment let people say what they want to say, practice whatever religion they want, publish anything they want, and be able to assemble whenever and wherever they want (not including private property). This keeps people from being punished for doing something against the government that is not harmful.

What current event shows amendment one?

One current event that shows amendment one (freedom of speech and press) was that a magazine said that Kate Winslet used a diet doctor without a reason or a source. Kate Winslet decided to sue the magazine company for libel because it was not true. Kate got an apology from the company as well as damages and legal costs. I think that they should have to send a story that they are not 100% sure is true to the person it is on to be approved.

Another current event that shows amendment one (freedom of religion) is that some public school excused jewish children from school for Yom Kippur so they could go to religious services. This should not be allowed because it would show a preference for that group. I think that they should let everyone off of school because they can't just let one group go and not another.

Another current event that shows amendment one (freedom of assembly) is the gay pride parade. The gay pride parade is where people that support same sex marriage and gay people.I think that this is a good idea because I think that they should be able to get married like anyone else.

The last current event that shows amendment one (freedom of petition) is that a girl in middle school plays for her school football team. That part is fine but people are saying that next year she is not allowed to play. She doesn't think that it is fair to she started an online petition to let girls play football. I think that girls should be allowed to play football because they should be allowed to do anything that a man could do even if not a lot of girls would want to do it.

Amendment 2: The right to Bear Arms

What right does it give people?

It gives people to bear arms. In other words it lets people own weapons.

What restrictions are there?

Well all amendments have tons of small exceptions but the biggest one for amendment 2 is that someone cannot own a weapon of mass destruction like a nuclear bomb but there are huge debates about what are weapons of mass destruction? Well no one really knows because everyone has their own opinion. My opinion is that no one should be allowed to have guns or weapons.

Why was this amendment included in the constitution?

This was included in the Constitution so that a president or powerful person can't just takeover, because the people could defend themselves.

What current event shows amendment two?

One current event that shows amendment two is the shooting at Sandy Hook Elementary School. The shooter himself was not allowed to own the guns but his mother could. His mother was allowed and certified to own the guns but he was not. She was allowed to have the guns and use them and he could just take them and then he just went to the school and killed 28 people.
