Now that you have been served, you have gained the title of plaintiff. A plaintiff is person who brings a case against another in a court of law. Then you will have a defendant with the court of law. A complaint will be for civil actions. You will then receive a summons. Then your pleading will tell you the cause of an action or defense. Your pretrial conferences is a conference held before the trial begins to bring the parties together to outline discovery proceedings and to define the issues to be tried more useful in civil than in criminal cases. A mediation will be set to resolve the issues. Arbitration will settle the dispute. The trial is a formal examination of evidence before a judge, and typically before a jury, in order to decide guilt in a case of criminal or civil proceedings. Preponderance of evidence is required in a civil case and is contrasted with "beyond a reasonable doubt," which is the more severe test of evidence required to convict in a criminal trial. No matter what the definition stated in various legal opinions, the meaning is somewhat subjective.
