Does 9th-grader's head-banging signal need for different interventions?
A student with autism had a history of aggressive and self-injurious behaviors during his first year at a new school. His Ohio district successfully managed his behaviors in eighth grade using a combination of de-escalation and sensory techniques. When the teenager's head-banging and aggression escalated in ninth grade -- his first year at the district's high school -- the parent asked the district for a crisis intervention plan. The parent withdrew the student from school in October 2021 after his 12th incident of seclusion in seven weeks.
The parent alleged that the district violated the IDEA by monitoring the student's behavior for two months without reviewing or revising the BIP. The district noted that it continued implementing the eighth-grade BIP, which had been revised in November of that year, and that it collected data about the teen's behaviors so the team could discuss the need for revisions.
The IDEA requires a student's IEP team to review his IEP at least once a year and revise the IEP as appropriate. 34 CFR 300.324 (b)(1).
Did the district violate the IDEA by failing to revise the BIP?

TIP OF THE WEEK
Continue to provide services to students after MDR
Districts must continue to provide services to students regardless of the outcome of a manifestation determination review and regardless of how serious the misconduct is. "It's a separation, not a divorce," he said. Districts aren't required to provide children suspended for more than 10 school days in a school year exactly the same services in exactly the same settings as they were receiving prior to the imposition of discipline. However, the services the child does receive must enable her to continue to participate in the general curriculum and progress toward meeting the goals set out in her IEP. 34 CFR 300.530 (d); 34 CFR 300.531.
