AHSAA “BYLAW OF THE WEEK”
“BYLAW OF THE WEEK”
Scenario: Bill is a 9th grade golfer for Sylacauga HS. He was an All-State performer his 8th grade season and expects to have a chance to win the state championship(s) and receive scholarship offers with continued success. His family decides they want a house on the river, so they purchase a home, on the river, in Alexander City and intend to enroll Bill at Benjamin Russell HS. The family moves into the home but wants to keep their original home for the grandmother, who lives with them, to continue to live in. Question: According to AHSAA bylaws, will Bill be eligible to compete at Benjamin Russell HS this season?
Rule 1, Section 12. Transfer Rule:
“A student that enrolls in one school and later transfers to, or enrolls in, another school shall not be eligible immediately to represent the latter school in any athletic contest.”
Exception 3. Bona Fide Move – “Sometimes it is very difficult to determine what constitutes a bona fine move. Family and home conditions differ and must be considered. The following factors are basic guidelines for determining a bona fide move:
a. The household furniture of the family must be vacated into an unoccupied house or apartment.
b. All principal members of the family must reside in the new place of residence.
c. The original residence should be closed, rented or disposed of and not used by the family.
d. Nine months at the new residence will be required to make a move bona fide.”
Ruling: Bill is not eligible at Benjamin Russell HS until a bona fide move has taken place. The previous home must be vacated first. All furniture, clothes, etc. must be moved into the new home or in storage. Bill’s mom, dad and any other siblings must all move into the new home. After the family has vacated the previous home, the principal of Benjamin Russell HS would be responsible for checking the residence to ensure the family is compliant with a bona fide move. Once the family has vacated the home, the grandmother can then move “her” furniture and belongings into the home. The original home would have to be sold or leased/rented to the grandmother with utilities put into the grandmother’s name.
Penalty: If the conditions above are met, Bill would be eligible at Benjamin Russell HS as long as all other eligibility requirements are met. However, if the principal fails to check the previous residence in Sylacauga or if the family returns to the previous home in less than nine months, Bill would be ineligible at Benjamin Russell HS. If he has participated in any athletic contests prior to this discovery, all events in which he participated in would have to be forfeited. The school would be subject to a monetary fine and placed on probation. Furthermore, once Bill becomes an eligible athlete, he would be required to serve restitution equal to the contests he participated ineligibly.
Proactive Measures: The principal of the receiving school is ultimately responsible for evaluating all transfers and new enrollees. Each case is unique and must be thoroughly investigated to ensure the school remains compliant to AHSAA transfer rules. To be proactive, the principal and athletic director should assume all transfers are ineligible to compete immediately. Thereafter, they should analyze the exceptions under the transfer rule to determine if the student is eligible to compete. If the school has questions, the principal or athletic director may contact the AHSAA for an interpretation.
