Bill of rights, 10 amenddement
- The power not delegated to the United States by the constitution, nor prohibited by it to the state, are reserved to the states respectively or to the people.
McCullough vs. Maryland
- The court declared the constitution of a nation bank under the "elastic clause" of the constitution which gives congress the authority to make laws necessary to carry out the work of the federal government. It also found the states do not have the right to tax the federal government.
Davion scenario
- In the state of Texas, the state wants to tear down the local houses by the pharmacy so the could build a gas station. The home owners wanted to take this to court because the thought it wouldn't be fair. When they went to court the judge says they could do it because if the constitution doesn't say anywhere that the state can't do something, then the state have's the power to do it. So the judge ruled it and he said no because they wouldn't have a home to live in. The people were lucky because the could have tour there home down. The state built the gas station somewhere else.
