Who are You, and Where do You Stand? First things first, you must know who you are and where you stand. Filing a lawsuit, you are the plaintiff. The person that you are filing against is the defendant. | The Beginning Steps First, we will need to send a complaint to the defendant. If the defendant responds, you will be scheduled for a pretrial conference. This is to determine how many witnesses will be called, how long the trial will be, discuss the possibility of settlement and etc. For example, the possibility of mediation and arbitration could be discussed. If the defendant does not respond, they will receive a summons, directing them to go to court for the case. | The Trial At the trial, we will listen to the defendants pleadings.
