Description
Summary
Court Case
There was an argument regarding the ratification process taking place. Regulating the amount of time that is allowed to pass between initial passage and its eventful ratification. In 1924 the child labor amendment was passed, 3-5ths must vote for it to pass but it was 50-50. Kansas was the final deciding vote. This amendment was rejected but then later brought up to the senate. It then was passed. Rolla Coleman, a state senator, and 23 other people then sued Clarence Miller, who was the secretary of the state senate. They did not believe that Kansas' ratification process was constitutional. This was then taken to the supreme court in Kansas where they had a 7-2 decision. There reasoning was it was not in the supremem courts hands. They said that any amendment that was not given a deadline may be ratified at any given time.
