CACFP UPDATES
CACFP Program Year 2022-2023 (PY23)
Waiver Updates
- Non-congregate feeding
- Meal service time flexibilities that allow bundling of meals
- No child present/parent pick-up
- Offsite monitoring
CACFP operators may utilize offsite monitoring waivers through June 30, 2023. Currently, CACFP operators may only use non-congregate, meal time, and parent pick-up flexibilities in the event of a specific COVID-19 incident.
For all of the flexibilities described above, Contracting Entities must submit the applicable opt-in form located on the COVID-19 Intake Forms page (note that the opt-in form for Summer non-congregate feeding is under development and will be posted soon; SFSP and SSO operators may begin using these waivers prior to submitting the form).

USDA Provides Infant Formula Information for CACFP
Updated Nondiscrimination Statement
On May 5, 2022, the Food and Nutrition Service’s (FNS), Civil Rights Division, issued a memorandum on Bostock v. Clayton County and its application to USDA FNS Programs. The memorandum informed FNS program recipients that the prohibition of discrimination based on sex in Title IX and the Food and Nutrition Act includes gender identity and sexual orientation. The changes impact the USDA Nondiscrimination Statement (NDS).
The revised USDA NDS includes updated language for all other FNS programs. TDA is in the process of updating its handbooks, forms, and resources to reflect the new NDS, which can be found here: https://www.fns.usda.gov/civil-rights/usda-nondiscrimination-statement-other-fns-programs
NOTE: Currently a Spanish translation is being developed by USDA.
Operators using their own materials that include the NDS must update those materials when current supply on hand is exhausted or by September 30, 2023. All new printing should use the updated NDS.
