Due Process Rights

  • Due process means that laws must be applied fairly and equally to all people.

  • 5th is a citizen cannot be accused of a serious crime without a grand jury investigation. It also forbids double jeopardy — the act of bringing a person to trial a second time for the same crime.
  • 6th amendment gives you the right to a lawyer.
  • 8th protects you from cruel and unusual punishment.
  • 14th granted citizenship to “all persons born or naturalized in the United States,” which included former slaves recently freed. In addition, it forbids states from denying any person "life, liberty or property, without due process of law" or to "deny to any person within its jurisdiction the equal protection of the laws.”
