CASE FILE: Copious notes of parents' concerns squash lack of participation claim
Case name: New York City Dep't of Educ., 122 LRP 41396 (SEA NY 08/25/22).
Ruling: A New York state review officer sustained an impartial hearing officer's decision that a district provided the parents of an elementary schooler with a speech-language impairment a meaningful opportunity to participate in the creation of the student's IEP. The SRO dismissed the parents' appeal.
What it means: Parents may disagree with a proposed IEP or placement, but that does not mean that they were denied a chance to meaningfully participate in an IEP's creation. Instead, courts look to whether parents were able to voice their concerns. Districts can insulate themselves from an attack by taking copious notes about the parents' concerns and noting them in the IEP. IHOs, SROs, and the courts will find such notes particularly helpful.
