Step One
The first step in any civil case is the plaintiff making a complaint. After, The court sends a summon, which is a request for their appearance in court on a certain day and time. The defendant will respond or have their attorney respond. In defense pleadings, both sides gather evidence to help their case and exchange pleadings in response to the accusation at the pretrial conference.
Part Two
Most civil cases are settled outside of court in a mediation or in an arbitration. If the case is not settled outside of court it will go into a trial. Both sides show their preponderance of evidence and plead their case to the jury and the judge.After both sides plead their case, the judge or jury come up with a verdict. If either party is upset with what the jury or judge decides they can issue an appeal.
