School Searches

By: Madeleine Rawlings

Should the government be able to search students bags?

I personally think it is the right thing to do because students (mostly high schoolers) are doing very illegal things such as selling drugs and alcohol.

The Fourth Amendment

In the fourth amendment it states that the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Different Things the Government is Searching for.

Ask yourself these Questions

Is searching students bags and lockers the right thing to do? What would be going on if they didn't do this? Are they getting too involved in the whole searching thing?

My Side of School Searches

I think that the government should be able to search the bags and lockers of the students to make the school a safe learning environment. The government is keeping them safe from drugs, alcohol, and they are making sure that teens are making good choices/decisions. This whole situation was taken to court; that is how serious this all is.The state brought TLO to juvenile court. The court found the school official's search was reasonable and the Fourth Amendment did indeed pertain to school searches. The case went to the appellate division of the New Jersey Superior Court where the previous court's finding was upheld but supported the court's findings with other grounds than delinquency. The New Jersey Supreme Court found the search of the student's purse unreasonable and reversed the decision. The case then went to the U.S. Supreme Court. Put yourself in the place of the parents; how would you feel if you found out that your kids were taking drugs and drinking. You would be mad wouldn't you?

It would affect their learning, their job, and their future. All parents want their kids to have a good life and be successful. Let us all remind ourselves about how it is illegal to drink under the age of 21 and that drugs in all, are illegal. Would you want your teenage boy/girl in jail at the age of 14-18 (the recorded ages that this usually starts.)

That is why the government SHOULD search the bags of students. In my opinion there should be a limit of what they search. For example I think they should be able to search bags and lockers but then we go into the more private things. I think schools should not be able to search their phones there are way too many private things in phones such as texts, conversations, and pictures. All of these things can reveal a lot about someone. You may be asking what are some of the affects of drugs and alcohol? Well here are a few of the many things that could happen.

Alcohol: Alcohol poisoning, Liver disease, Nerve damage, Permanent damage to the brain , and Cancer of the mouth and throat

Drugs: Weaken the immune system, increasing susceptibility to infections, nausea, vomiting and abdominal pain.

Remember that these are only a few of the many effects, side affects.

Interview With a Fellow Student

I have interviewed a Blake Mitchell for her opinion on school searches.

ME: So blake what is your opinion on school searches?

BLAKE: I think it would be wrong if the government didn't search the students bags and lockers because like you said teenagers are doing illegal things that can put them in danger and even jail.
