CRIMINAL COVERAGE (Act or Omission within the Scope of Employment)
Applies to Participants enrolled in Benefit Plans I, II, III & IV.
FULL representation by an experienced criminal attorney from the outset of the investigation through trial, regardless of which agency does the investigation:
- FBI
- STATE
- LOCAL
CIVIL COVERAGE (Act or Omission within the Scope of Employment)
Applies to Participants enrolled in Benefit Plans I, II, III & IV.
When your employing agency defends and indemnifies you, the Legal Defense Fund will provide an experienced attorney to monitor your case. This means that she is available to answer your questions about the case, review the pleadings and discovery, watch for conflicts between you and your employer, and watch for inadequate representation.
If there is:
- A legal conflict of interest between you and your employer;
- Inadequate representation by your employer;
- A considerable likelihood that punitive damages could be awarded against you;
- If your employer refuses to represent you for an act or omission with the scope of your employment;
You will be provided with independent counsel by the Legal Defense Fund
ADMINISTRATIVE DISCIPLINE COVERAGE
Applies to Participants enrolled in Benefit Plan I only:
Representation in cases arising from an act or omission within scope of employment (non-scope administrative coverage through Skelly).
Applies to Participants enrolled in Benefit Plan III only:
Representation in cases arising from an act or omission within scope of employment. Administrative coverage shall include only those actions in which:
- The discharge of a weapon is involved; or
- Serious injury or death occurrs; or
- "Miranda" warnings are given to the Participant and not followed by an admonition that any statement made in administrative interrogation may not be used in criminal proceedings against officers;
- The Participant has been given formal written notice of proposed administrative discipline in the form of a suspension of more than forty (40) hours.
SCOPE OF EMPLOYMENT
Some services may only be provided if the action against the Participant is within the Scope of Employment. Actions which arise from personal and private conduct and/or activities may not be eligible for coverage, depending on the Benefit Plan in which you are enrolled and the type of coverage needed. Article I, Section 22 of the LDF Plan Document defines Scope of Employment as follows:
“Scope of Employment” – generally defined as actions or omissions by a Peace Officer or Public Safety Employee which are typical of or associated with the duties which a Peace Officer or Public Safety Employee is hired, trained, and paid to perform, as determined by the Board of Trustees.”
