Annual Financial Submission Report and Training
The Audit application in TEA Login (TEAL) is currently open to accept the fiscal year 2022 Annual Financial Report (AFR) submissions.

There will be two webinar trainings that will cover the annual financial audit report data feed and PDF submission process and will be two hours to allow for questions. The trainings will be similar other than the differences in the data feed schedules for charter schools and ISDs. TEA plans on recording and posting the trainings on the web at a later date.

- 11/30/2022 by 11:59pm CST - Data collection tool due from LEAs to TEA. Data submission closes.
- 12/31/2022 - TEA submits request on behalf of LEAs to USDE.
- January/February 2023 - USDE responds to request from TEA.

Bilingual Exceptions and ESL Waivers are due November 1
The 2022-2023 Bilingual Education Exception/English as a Second Language (ESL) Waiver application and instructions, including a video explanation, are now available on the TEA Bilingual Exception and ESL Waiver Resources webpage.
All local educational agencies (LEAs), including all districts, charter schools, and districts of innovation, are required to identify and serve emergent bilingual (EB) students/English learners (ELs) through bilingual education or English as a second language (ESL) programs, per 19 TAC §89.1205.
Pursuant to 19 TAC §89.1207(a)(1) and (b)(1), an LEA that does not have the appropriately certified teachers for their required bilingual education and/or ESL program(s) must apply to the Texas Education Agency (TEA) for a bilingual education exception and/or ESL waiver. The approval of an exception and/or a waiver shall be valid only during the school year for which it was granted.

Title I, Part A - Comparability of Services Requirement
Summary of TEA Communication
Each year, local educational agencies (LEAs) that receive Title I, Part A funding are required to document their compliance with the Title I, Part A Comparability of Services requirement under the Every Student Succeeds Act (ESSA).
Requirement:
- All LEAs that receive Title I, Part A funding must complete and submit to the Texas Education Agency (TEA) the CAD survey. The CAD is available for completion and submission electronically through an online survey.
- LEAs that do not meet one of the defined exemption criteria must also complete and submit to TEA the CCF.
The CCF, along with instructions for completing/submitting that form and the instructions for completing/submitting the CAD survey, are available on the Title I, Part A Comparability of Services page of the TEA website and through the Grants and Federal Fiscal Compliance Reports and Data Collections (GFFC Reports) secure application, accessible through TEAL.
The deadline for submitting the CAD, and CCF if applicable, is November 18, 2022.
New Grant - Silent Panic Alert Technology (SPAT)

The purpose of this grant is to provide funds to local educational agencies (LEAs) to purchase silent panic alert technologies for campuses as a measure of school safety. Grant application is accessible in TEAL eGrants. Due by December 12, 2022

2023-2025 School Safety Standards Formula Grant
TEA will release a formula-based grant application in the coming weeks to support the school safety standards proposed rules referenced above. The grant will allow for pre-award for items purchased on or after June 1, 2022.
Allocation Methodology
This grant program will calculate formula allocations based on a per-pupil amount per LEA. Grant funds will be distributed by per-pupil counts that were derived from age 3-21 student enrollment as reported in the October 2021 PEIMS submission. There will be a $200,000 grant allocation for smaller and rural LEAs, even if using the per-pupil methodology they would receive less than the $200,000 minimum grant award.
Eligibility Criteria
Public school districts and charter schools with a reported enrollment of at least one student from the October 2021 PEIMS fall snapshot submission will be eligible for funding. New charter schools that opened in the 2022-2023 school year, prior to October 27, 2022, will be eligible for the minimum grant award amount. Any new charter school opening after October 27, 2022 (the date of announcement from Office of the Governor) will be ineligible for funding throughout the life of the grant. Private schools are not eligible recipients for funding.
Allowable Uses
The grant will allow spending on a variety of security-related items identified by the needs of each LEA. The grant will allow for various costs associated with school safety and security; however, the grant will come with a requirement that money must first be spent on items necessary to comply with the rule. Once the standards of the rule are met, remaining funds can be spent on other eligible security-related costs as defined in the grant program allowable costs.

Title I, Part D
LEAs that have a residential facility for neglected or delinquent children located within their geographic boundaries or provide for the education of students who reside in that residential facility must respond to the 2023–2024 SC9000 survey by December 2, 2022.
The 2023–2024 SC9000 is available only to those LEAs in TEAL. For more information go to the 2023–2024 Annual Survey of Children in Local Residential Facilities for the Neglected/Delinquent (SC9000).
2022-2023 ESSA Random Validation Updates
- Phase 2 notifications will be sent out on Nov. 28th and documentation will be due on Dec. 12th.
- LEAs will use the newly developed FPC Random Validations WorkApp System to submit their documentation. Detailed written instructions and training videos on how to submit documentation using the new system can be found here.

Applicant Designation and Certification (ADC) Form
The ADC form must be submitted before the grant application is available in eGrants. To access the ADC, log into TEAL and select eGrants as the application. Once in eGrants, click on Grants on the menu bar.

SSA Members Requirement for EDGAR Manual Updates Based on Audit Finding
For 2021-22, Region 10 Title II, Part A SSA had an audit in which the reimbursements from several LEAs were reviewed. There was one audit finding in the procurement procedures specific to small purchases.
Action Steps:
- Update Manual with New Requirement: Check your procurement section of the EDGAR manual. Make sure that it has the most up to date information and it follows the most restrictive requirements (Federal vs. State vs. Local) Example: EDGAR Manual Procurement Section

New LEA Title IV, Part A Special Data Collection for Public Reporting - Session ID 91768
Come and learn about the new LEA Title IV, Part A Special Collection. Information about the data requirements that must be collected and publicly reported will be shared. In this session, LEAs will learn what type of data is required, reporting cycles, and collection method for Title IV, Part A expenditures by content area and the progress toward meeting Title IV, Part A objectives and measurable outcomes to be publicly reported as required by statute. The new data requirements will require LEAs to report data by service/content area and expenditures over a 27-month cycle.
ESC TIVA: Prohibition of ESEA funds for Dangerous Weapons (As of 6/25/2022)
TEA has requested that we share the following information, because some LEAs may not be aware of Errata #2 posted for the 2022-2023 ESSA Consolidated Federal Grant Application on 8/26/2022.

26. Prohibition of ESEA Program Funds Used for Possession of and/or Training with Dangerous Weapons: The LEA assures that no funds under the ESEA will be used for the provision to any person of a dangerous weapon, as defined in section 930(g)(2) of title 18, United States Code, or training in the use of a dangerous weapon. [Section 8526 of the Elementary and Secondary Education Act of 1965 (ESEA) as amended by the Bipartisan Safer Communities Act, Section 2938, Division A-Mental Health and Firearms Provisions, Title III-Other Matters, Subtitle D-Amendment on ESEA Funding, Section 13401]
A dangerous weapon is defined in section 930(g)(2) as a weapon, device, instrument, material, or substance, animate or inanimate, that is used for, or is readily capable of, causing death or serious bodily injury, except that such term does not include a pocketknife with a blade of less than 2 1/2 inches in length.
Please note, the prohibition went into effect immediately on June 25, 2022, and applies to all ESEA funds, existing and future awards under all ESEA programs.
*districts may continue to pay for SROs and ISD police officers with ESEA funds

Title IV, Part A Federal funds can not be used to meet state or local safety and mental health requirements. LEAs and ESCs can use this chart to help with Title IV, Part A use of funds questions.

REMINDERS:
ESSER I grant ended on September 30, 2022.
ESSER I funds must have been obligated by 9/30/2022 (per 34 CFR 76.707).
ESSER I liquidation period has been extended until you file your Final and/or Revised Expenditure Report on 1/2/2023. ESSER I SSA Members - Date for Final/Revised Expenditure Report is Oct. 7, 2022.
TEA will release information regarding a liquidation extension. This extension will only be applicable due to supply chain issues, not to obligate the funds. If your LEA will apply for this liquidation extension for ESSER I, make sure to be in the lookout for TEA's email.
ESSER II, III, & SUPP

Fiscal Validations
ESSER I, ESSER II, and ESSER III Fiscal Validations
LEAs receive notification of fiscal validation and have 10 days to submit documentation via a secure link.
ESSER USDE Reporting Requirements
Join us for the ESSER Reporting Training by TEA and TASBO.
Region 10 will reserve a room for you to attend the training. The training will be hosted virtually from Region 13.

MOEquity to the Administrator Addressed

Every LEA will need to check the MOEquity Automatically Excepted List (exemption list) to verify the information.
If your LEA has been included or excluded from the list due to data reporting error, you must notify TEA by emailing Compliance@tea.texas.gov no later than Dec. 9, 2022. Keep in mind, if you have an alternative campus, it must be included for determining LEA-level MOEquity compliance (see MOQ-Q24, in TEA’s ESSER FAQs for additional details).

Changes to the ESSER State Expenditure Report
TEA is in the process of revising the expenditure report so fewer items fall into the OTHER category.
USDE is reviewing is of these OTHER expenditures 1 by 1.

ESSER Technical Assistance Tuesday for SSA Members
Participant Support Costs for Private Schools
The ESSA statute allows for private non-profit staff to participate in allowable professional development activities. The direct cost of registration and travel to conferences meets the EDGAR definition of ‘participant support cost.’ If you are providing equitable services to private schools and they request to participate in professional development activities, the district must complete the Participant Support Costs form and maintain a copy to document the approval for expending federal grant funds on participant support costs. This documentation must be available to auditors, upon request.

Equipment and supplies purchased by an LEA with CARES Act funds to provide equitable services to students and teachers in a private nonprofit school may be used for the authorized purposes of a CARES Act program during the period of performance (i.e., through September 30, 2022) or until the equipment and supplies are no longer needed for the purposes of the program.

- Conduct Parent-Teacher Conferences where school-parent compacts are discussed (required at the elementary level.) ESSA Section 1116 (d)(2)(A)
- Convene and document the Title I, Part A Annual Parent Meetings for each Title I, Part A Campus. ESSA Section 1116 (c)(1): explain the program requirements, inform parents of their right to be involved, and explain the Reservation of Funds for parental engagement and the parents’ role in deciding the use of the funds (for schools receiving $500,000 or more Title I, Part A funds.)
- Provide communications about the Title I, Part A program in a format, and the extent practicable, in a language parents understand. (Provide information to parents in a format and language they understand is practiced throughout the school year.) ESSA Sections 1112 (e)(4) and 1116 (b)(1) & (e)(5)
- If this has not been done already, distribute the District and Campus Parental Engagement Policies to parents and families. ESSA 1116 (a)(2) & (b)(1) o If this has not been done already, distribute the School-Parent Compact to parents and families. ESSA Section 1116 (d) o The Schoolwide Plan/Campus Improvement Plan shall be available to parents and families. ESSA Section 1114 (b)(2) & (4)
- A school district that assigns an inappropriately certified or uncertified teacher to the same classroom for more than 4 consecutive weeks during the same school year shall provide written notice of the assignment to a parent or guardian of each student in that classroom. ESSA Section 1112 (e)(1)(B)
